To provide our services, we process personal data. This privacy policy explains which personal data we process and how we handle it. We comply with all applicable data protection laws and regulations in the Netherlands. For more information, you can consult the website of the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).Urban Gym Group B.V., located at Silodam 402, 1013 AW Amsterdam, is responsible for the processing of personal data of members, customers, suppliers, and prospects.What Are Personal Data?Personal data are data relating to an identified or identifiable natural person. This includes information that can identify you, such as your name, (email) address, phone number, date of birth, photo, and/or bank account number.Processing of Personal Data of Members, Customers, or SuppliersUrban Gym Group generally does not collect personal data directly but obtains it through its role as the parent company of its brands. The following data may be received from you or provided by you, if you choose to do so:
First and last name, email address, (home) address, gender, and phone number: We use this information to fulfil agreements (such as memberships) with one of our brands and for related administrative communication. Additionally, this data is processed for interactions with Urban Gym Group, for example, through social media or other communication channels.
Date of birth: Your date of birth is processed to determine if you are of legal age (16+) and can independently access one of Urban Gym Group’s clubs, for example, for a (free) trial, day pass, and/or membership.
Bank account number (IBAN): When a payment is made via one of our brands’ websites, we automatically receive your payment details. We also process your IBAN for automatic (periodic) direct debits for subscription fees.
Additionally, Urban Gym Group obtains personal data from interested parties and/or prospects, including first and last name, email address, and phone number. This processing is based on our legitimate interest. Urban Gym Group has a legitimate (commercial) interest in responding to information requests from individuals, for example, when an interested party fills out the contact form on our website or submits a digital request (for contact) via social media platforms such as LinkedIn, Facebook, or Instagram.Legal Basis for Data ProcessingUrban Gym Group relies on the legal bases for processing as outlined in Article 6 of the GDPR.One of the bases we rely on is the necessity to use your data for administrative purposes, such as entering into and fulfilling agreements with you at one of our brands. This applies when concluding a membership (including related features such as club access, class bookings, app usage, and payments) and when registering and renewing that membership.We may also process your personal data when we have a legitimate interest. For example, we analyse your data to improve our services and for internal management. We also have a legitimate (commercial) interest in informing you when you request more information about Urban Gym Group. Additionally, we (or our brands) will send newsletters to members based on our commercial interest.Another legal basis we rely on is consent. For example, you give consent for the use of cookies. With these cookies, we can show or send you information, offers, and advertisements tailored to you. For more information about cookies and how we handle them, please refer to our cookie policy, where you can also adjust your cookie preferences.We generally do not process personal data of minors (individuals under 16 years of age). This is different if a minor contacts us for more information. In this context, we do not process sensitive or special categories of personal data.Retention PeriodWe retain your data for as long as you are a member or subscribed to our newsletter. If your membership ends and is not renewed, or if you unsubscribe from the newsletter, your data will be automatically deleted within two years.The retention period for data of prospects and/or interested parties is the period during which you are considered a prospect by us. This is 90 days.Exceptions to this are data that we must retain for longer due to legal obligations or our legitimate interest. For example, tax laws require us to retain certain financial data for 7 years. Information about the handling of questions or complaints is retained for a maximum of 2 years after resolution.Sharing with Third PartiesWe will not share your personal data with third parties without your explicit consent, unless legally required. However, there are a few exceptions.As the parent company of its brands, Urban Gym Group works with various parties involved in delivering our services, who act as processors. These processors perform certain parts of our services and help us fulfil our obligations to you. Where necessary, we have entered into processor agreements with them, clearly stating which personal data they may process and for what specific purposes. For individuals whose personal data is processed, Urban Gym Group remains the primary point of contact for questions or concerns regarding data processing.These processing activities include, among others:
Systems for booking group classes;
Providing a personal QR code for the TrainMore brand in the TrainMore App for club access;
Developing and using the TrainMore App for the TrainMore brand;
Managing financial administration; and
Ensuring GDPR compliance for our online environment.
We will not provide the data you have provided to other parties unless legally required or permitted. For example, the police may request (personal) data from us as part of an investigation. In such cases, we are obligated to cooperate and provide the requested data.In some cases, you have given us permission to share your browsing behaviour and preferences with third parties. Based on this consent, we can show you targeted information or offers when you visit an external website. In such cases, we only share your IP address and no other personal data.We do not provide personal data to parties located outside the European Union.Processing Personal Data Within the Urban Gym GroupUrban Gym Group is the parent company, which includes brands such as TrainMore, ClubSportive, GYM BOX, RUSH, TRIB3, PILAT3S, and BTY CLB. For certain purposes, we may share your personal data within the Urban Gym Group. This is only permitted (and we will only do so) for administrative purposes, improving services, internal management (internal analyses), and/or fulfilling agreements. For more information, see the section on "legal bases for processing".CCTV SurveillanceAt the request of Urban Gym Group, its brands implement CCTV surveillance. All brands follow Urban Gym Group’s instructions.CCTV surveillance (where necessary, live) is used for:
Access control to clubs;
Monitoring and securing goods and individuals present in sports clubs;
Preventing and recording nuisances, such as vandalism and violence against individuals.
No other personal data is processed except:
CCTV footage of buildings and premises, including individuals and objects under Urban Gym Group’s responsibility;
Data regarding the time, date, and location where the CCTV footage was recorded.
Hidden cameras are not used.Urban Gym Group is transparent about the use of cameras. Where cameras are in use, this is indicated, for example, by stickers or signs.No cameras are installed in changing rooms or toilets.Implementation of CCTV Surveillance:
CCTV surveillance is carried out in practice by the control room and staff at the respective location. Occasionally, a third party is engaged to record or monitor CCTV footage, for example, by external control rooms when monitoring clubs that are temporarily unmanned. Urban Gym Group and the control room of the brand remain ultimately responsible for the implementation of CCTV surveillance.
CCTV footage is retained for a maximum of 30 days, unless a longer period is necessary for handling a reported incident.
The control room has taken adequate measures to prevent unauthorised access or misuse of stored CCTV footage.
Individuals authorised to review footage are explicitly bound by confidentiality. Access to the footage is password-protected.
Access, Copies, Deletion, or Masking of CCTV Footage:
A specified request from an individual for access to and copies of CCTV footage, including the relevant day, time period, and location, can be submitted to Urban Gym Group (via privacy@urbangymgroup.com).
A request from an individual for deletion or masking of CCTV footage can be made if the footage is incomplete or irrelevant for the purpose of processing or is otherwise processed in violation of legal provisions.
The request may be refused if disclosure would infringe on the privacy interests of other individuals.
CCTV footage is only provided to a competent government authority if a lawful (preferably written) order from the relevant authority is received or if another legal regulation obliges Urban Gym Group to do so.
SecurityWe have implemented appropriate technical and organisational measures to protect your personal data from unlawful processing. For example, we have taken the following measures:
All individuals who may access your data on behalf of Urban Gym Group are bound by confidentiality;
We enforce username and password policies on all our systems;
We pseudonymise and encrypt personal data where necessary;
We create backups of personal data to restore it in the event of physical or technical incidents;
We regularly test and evaluate our measures;
Our employees are informed about the importance of protecting personal data by the Privacy Officer and the Data Protection Officer.
